Boscia SATISFACTION GUARANTEE

At Boscia, LLC (“Boscia”), we stand behind our products and quality controls.  If you are not satisfied with a Boscia product you purchased from our website or one of our authorized sellers in the United States, you may request a refund [or replacement product] within 60 days of the date of purchase. 

Please note that because we are unable to control the quality of our products sold by unauthorized sellers, unless otherwise prohibited by law, the Boscia Satisfaction Guarantee is not available for products purchased from unauthorized sellers, including unauthorized internet sites.  The Guarantee is also limited to original, end-user purchasers in the United States.

How To Claim The Guarantee

To submit a Guarantee request, please have information available regarding where and when you purchased your product.  You will be asked to provide proof of purchase and submit photos of your product or its packaging.  You may also be asked to provide other information to assist Boscia in processing your request.  You must submit your Guarantee request within 60 days of the date of original purchase.  Please note that you are responsible for costs incurred in mailing your product and proof of purchase.

Guarantee Guidelines

Boscia reserves the right to verify information, require a valid proof of purchase, and to deny Guarantee requests in its discretion in cases of suspected fraud or where Boscia concludes that the purchaser has abused the Boscia Satisfaction Guarantee.  Boscia may amend or terminate the Boscia Satisfaction Guarantee at any time without notice.  If you have any questions regarding whether a seller is an authorized seller of our products, please contact us at 888-635-8884.

Except where prohibited by applicable law, you waive and agree not to assert any copyrights or “moral” rights or claim resulting from our alteration of the User Content or any work contained in the User Content.

We collect Personal Information when you create an account with us to make purchases or to sign up for a recurring subscription. To create an account, you will need to provide us with your name, email address and a password. Once you create an account, you have the option to add one or more addresses to your account address to expedite the checkout process for purchases you make through boscia.com. If you reside in the United States, you may also elect to provide us with your telephone number to receive SMS messages from us. You can update or delete any of the addresses you add to your account.

Trusted Service Providers. 
We may share your Personal Information with third-party service providers we engage to help us administer and operate boscia.com, to process and fulfill your orders, and to communicate with you. The types of vendors to whom we entrust Personal Information include: (i) IT services, including hosting boscia.com (ii) communications service providers who help us send newsletters and other marketing emails and SMS messages; (iii) payment processing and order fulfillment services; and (iv) providers of customer support services. These service providers have access to your Personal Information only for the purpose of performing services on our behalf.

Shipping

Shipping Notice: Free 3-7-day shipping via UPS or FedEx for orders over $60 is offered only to the contiguous 48 states. $7.95 shipping charge on all other orders. Excludes Alaska, Hawaii, Military addresses, U.S territories (including Virgin Islands, Guam and Puerto Rico) and PO boxes. Orders are not processed on weekends or major holidays. Please allow extra processing time for peak holiday season (Nov. - Dec.) Orders placed after 7am PST/10am EST Mon-Fri will require one additional business day for processing. Available on in-stock items only. Please note UPS does not deliver on Saturdays, Sundays and holidays.

Please note that we do not ship internationally at this time. 

Orders will not ship until payment is verified and/or corrected (if applicable). If you have placed an order via PayPal, please note, PayPal does process funds immediately, however, Boscia will still need to process your order. Once your order has been processed by boscia, you will receive a confirmation from boscia. Please ensure you enter the correct shipping address as any delays due to incorrect delivery addresses will delay arrival. Customers are responsible for all costs involved in re-shipping goods when a submitted address is incorrect or incomplete, or if the delivery was unable to be completed due to the customer’s absence. Orders that are refused, returned to sender or never claimed from the carrier will be subject to a 20% restocking fee, and will incur a charge to be reshipped, varying depending on the recipient’s location. If a refund is requested please note that the original shipping fees are non-refundable and a refund for the merchandise is only issued once the packages are returned to our facility. Please note, we have no control over packages that are delivered incorrectly or delivery addresses that are entered incorrectly and we cannot be held responsible for them. All delivery times are estimates and subject to change.

The boscia Alerts service (the "Service") is operated by boscia LLC ("boscia LLC", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. We may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and Data Rates May Apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted-in, the Service provides updates, alerts, information, promotions, specials, and other marketing offers from boscia via text messages through your wireless provider to the mobile number you provided. Message frequency is recurring. Text the single keyword command STOP to +1 833-299-2780 to cancel at any time. You'll receive a one-time opt-out confirmation text message. If you have subscribed to other boscia mobile message programs and wish to cancel, you will need to opt-out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you change your mobile phone number, you agree to opt out of the Service prior to changing your mobile number.

You agree to indemnify, defend, and hold us harmless from any third party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
